The South African prosecutors announced Sunday, Sept. 2, he would suspend the murder charge 270 strikers arrested after shooting mine Marikana August 16. These strikers were indicted Thursday for the murder of 34 of their comrades killed by the police.
This somewhat surreal charge was based on a technical clause providing that the law be charged with murder all those arrested at the site of a shooting involving the police, the victims are police officers or not.
The charge caused a wave of indignation: the magistrate would have relied on a provision of a law in riot remonstrating 1956, and ever since rewritten. Many jurists have expressed surprise at the use of a law dating from the apartheid regime. The Minister of Justice, meanwhile, asked for explanations.
"The murder charge current of 270 suspects, which anyway was temporary, will be temporarily withdrawn by the court at their next appearance," said the chief prosecutor, Nomgcobo Jibo at a press conference.
